Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WheelBazaar mobile application and website (collectively, the "Service") provided by WheelBazaar ("we", "our", or "us"), based in Chitwan, Nepal.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. User Accounts

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and not share it with others.
• Notify us immediately at wheelbazaar@gmail.com if you suspect unauthorised access to your account.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behaviour.

3. Listings

When you post a vehicle listing on WheelBazaar, you agree that:

• All information provided — including photos, description, price, mileage, and condition — is accurate and not misleading.
• You are the legal owner of the vehicle or have the authority to sell it on behalf of the owner.
• The vehicle is legally registered and roadworthy (or any limitations are clearly disclosed).
• You will promptly remove or update listings once a vehicle is sold or no longer available.
• Listing prices must be in Nepali Rupees (NPR) unless otherwise stated.

4. Prohibited Content and Conduct

You must not use the Service to:

• Post listings for stolen, illegally modified, or unregistered vehicles.
• Post false, misleading, or fraudulent listings.
• Harass, threaten, or abuse other users through the messaging system.
• Post spam, unsolicited advertising, or repeated duplicate listings.
• Attempt to circumvent the platform by moving communications off-app to avoid accountability.
• Scrape, crawl, or systematically extract data from the Service.
• Use the Service for any unlawful purpose or in violation of Nepali law.
• Impersonate another person or misrepresent your affiliation with any entity.

We reserve the right to remove any listing or content that violates these rules, and to suspend or ban users who engage in prohibited conduct.

5. Transactions and Payments

WheelBazaar is a listing platform only. We do not facilitate or process payments between buyers and sellers. All transactions, negotiations, and payments are conducted directly between users.

We strongly recommend meeting in a safe, public location and verifying all vehicle documents (bluebook, registration, insurance) before completing any transaction. WheelBazaar is not responsible for the outcome of any transaction between users.

6. Reviews

Users may leave reviews for sellers they have interacted with. Reviews must be honest, based on genuine experience, and must not contain hate speech, defamatory content, or personal attacks. We reserve the right to remove reviews that violate these standards.

You may only leave one review per seller. Sellers may not review themselves or manipulate the review system.

7. Intellectual Property

The WheelBazaar name, logo, and all content created by us (design, code, text, graphics) are owned by WheelBazaar and protected by applicable intellectual property laws.

By posting content (photos, descriptions) on the Service, you grant WheelBazaar a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not endorse, verify, or guarantee the accuracy of any listing posted by users.

9. Limitation of Liability

To the fullest extent permitted by law, WheelBazaar and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Service.
• Any transaction or interaction between buyers and sellers on the platform.
• Unauthorised access to or alteration of your data.
• Any content posted by other users.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed NPR 5,000.

10. Account Deletion

You may delete your account at any time through the Profile section of the app. Deleting your account will permanently remove all your listings, messages, and personal data from our systems. This action is irreversible.

11. Termination by Us

We reserve the right to suspend or permanently terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or if required by law. We also reserve the right to discontinue the Service at any time.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Chitwan District, Nepal.

13. Changes to These Terms

We may modify these Terms at any time. We will notify users of significant changes via the app or email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
